  • You are providing your own information and are not impersonating any other person or entity.

  • Your use of the Site does not violate any applicable federal, state, or local laws or regulations.

  1. Lead Generation and Third-Party Providers

 

Our Site functions as an online marketplace and lead generation platform designed to connect you with independent third-party professionals, contractors, sellers, or service providers ("Third-Party Providers") who may fulfill your requests.

  • No Endorsement: We do not endorse, recommend, or validate the credentials, licensing, insurance, or quality of work of any Third-Party Provider.

  • No Contractual Party: We are not a party to any contract, agreement, or transaction entered into between you and a Third-Party Provider. Any dispute regarding services or products purchased from a Third-Party Provider must be resolved directly with them.

  • No Guarantees: We do not guarantee that any Third-Party Provider will contact you, accept your request, or offer the lowest available price.

  1. TCPA Consent and SMS Communication Rules

 

By providing your telephone number and clicking "Submit" (or the equivalent call-to-action button) on any of our lead capture forms, you express your written consent to the following communication and short code guidelines:

  • Program Name and Description: You authorize Savileads LLC and our designated Third-Party Providers to contact you via telephone calls, text messages (SMS/MMS), and emails. Text messages are sent to deliver marketing services, promotional offers, project matches, and updates related to your inquiries.

  • Automated Technology: You acknowledge that these communications may be initiated or delivered using automatic telephone dialing systems, artificial or pre-recorded voices, or automated text messaging software.

  • Message Frequency: Message frequency varies based on your interactions with our Site, your submitted inquiries, and responses from our network of Third-Party Providers.

  • Pricing Disclosure: Message and data rates may apply for any messages sent to you from us or to us from you. Check your mobile plan for details.

  • No Purchase Required: You understand that your consent to receive marketing communications is not a condition, directly or indirectly, of purchasing any property, goods, or services.

  • STOP Instructions (Opt-Out): You may opt out of text messages at any time. To stop receiving text messages from Savileads LLC, reply STOP to any message received. You will receive a one-time opt-out confirmation text, and no further messages will be sent to your mobile device unless you opt back in.

  • HELP Instructions and Support Contact: For customer support, assistance, or questions regarding our SMS program, reply HELP to any message, email us at inquiry@savileads.com, or use the contact information listed in Section 13 of these Terms.

  • Carrier Liability Disclaimer: Carriers are not liable for delayed or undelivered messages.

  1. Intellectual Property Rights

 

All content, features, and functionality on this Site—including but not limited to text, graphics, logos, icons, software, and design layouts—are the exclusive intellectual property of Savileads LLC or its licensors.

  • Limited License: You are granted a limited, non-exclusive, non-transferable, and revocable license to access the Site for personal, non-commercial purposes.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL Savileads LLC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE, SERVICES, OR YOUR INTERACTIONS WITH THIRD-PARTY PROVIDERS, REGARDLESS OF THE LEGAL THEORY ADVANCED.

  1. Indemnification

 

You agree to defend, indemnify, and hold harmless Savileads LLC and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your violation of any term of these Terms.

  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right.

  1. Governing Law and Jurisdiction

 

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of these Terms shall be instituted exclusively in the federal courts of the United States or the courts of the Commonwealth of Massachusetts, in each case located in Suffolk County. You waive any and all objections to the exercise of jurisdiction over you by such courts.

  1. Dispute Resolution and Class Action Waiver

 

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

  • Mandatory Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.

  • Class Action Waiver: YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims.

  1. Severability and Entire Agreement

 

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect. These Terms constitute the entire agreement between you and us regarding the use of the Site.

We reserve the right to revise and update these Terms at any time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes.
